Waiver & Release Agreement

This Waiver & Release Agreement (“Agreement”) is entered into by you, on behalf of yourself and your minor child(ren) (“you”), in favor of AnetaArt, Inc., doing business as Aneta Art Classes, and any of its officers, employees, contractors, and agents (collectively, “AnetaArt”).
By enrolling in or participating in any AnetaArt in-person or online class, program, camp, workshop, or event, you acknowledge and agree to the following:
1. Assumption of Risk & Release of Liability
You understand that participation in AnetaArt activities may involve the use of tools and materials that carry inherent risks, including but not limited to hot glue guns, sewing machines, needles, scissors, craft knives, and other art and design tools.
AnetaArt will take reasonable precautions to promote a safe learning environment; however, you acknowledge that accidents and injuries may still occur. You voluntarily assume all such risks on behalf of yourself and your minor child(ren).
You hereby release and hold harmless AnetaArt, and all of its officers, employees, contractors, and agents, from liability for any injury, illness, or death that may occur in connection with participation in AnetaArt activities, whether caused by the actions or inactions of your minor child(ren), other participants, or AnetaArt staff.
You also release from liability any person who provides reasonable medical assistance to your minor child(ren). You agree to inform AnetaArt of any medical conditions that may affect your child’s participation. At AnetaArt’s sole discretion, unsafe or disruptive behavior may result in removal from a class or program.
2. Online Participation & Safety Requirements
For the safety and quality of online instruction, students are expected to have their cameras turned on at the start of online classes. Continued participation may require cameras to remain on, when reasonably appropriate.
3. Photo & Media Release (with Opt-Out)
You consent to AnetaArt taking photographs and/or videos of your child(ren) during classes, programs, camps, workshops, or events. You understand that such photos and videos may be used for educational, promotional, advertising, or other lawful purposes.
You further consent to such photos and videos being displayed online, including on AnetaArt websites and social media platforms. You acknowledge that content may be edited, cropped, or otherwise modified and that you have no ownership or financial interest in such media.
You release AnetaArt and its officers, employees, contractors, and agents from all claims related to the use of photos or videos, including claims for invasion of privacy, right of publicity, misappropriation, or defamation. You acknowledge that media posted online may be downloaded or shared by third parties.
If you voluntarily submit photos or videos of your child(ren) to AnetaArt, you grant AnetaArt a worldwide, perpetual license to use such media for the purposes described above.
Photo & Media Opt-Out
If you do not consent to the use of photos or videos of your child(ren) for promotional or marketing purposes, you may opt out by notifying AnetaArt in writing at anetaartclasses@gmail.com prior to the start of the program. Your child will still be permitted to participate fully in all classes and activities.
4. Parent / Guardian Authority & Binding Effect
You represent and warrant that you are at least eighteen (18) years of age and have the legal authority to enter into this Agreement on behalf of yourself and your minor child(ren). This Agreement is binding upon you, your minor child(ren), and your respective heirs, assigns, and legal representatives.
5. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflicts of law principles.
